Welcome to Siesta Coffee's Customer Terms and Conditions

These Terms apply to all customers who visit or use any of our Siesta Coffee stores and facilities. By placing an order and using our services, you agree to the terms outlined below, which cover our liability limitations, customer responsibilities, and important details regarding food safety and allergies.

1. Agreement to Terms

By entering and using any Siesta Coffee premises, ordering products, or engaging with our services (including but not limited to food and beverage purchases, use of facilities, and events), you agree to these Terms and Conditions in full. If you do not agree to these Terms, you must not use our stores or services.

2. Liability Disclaimer

Siesta Coffee takes all reasonable steps to ensure the safety and quality of its products and services. However, Siesta Coffee shall not be held liable for any claims, losses, damages, or injuries arising from:

  • Negligence on the part of the customer or third parties.
  • Failure by the customer to follow instructions or adhere to posted safety information.
  • Food allergies or intolerances, where the customer has failed to inform us of such allergies.
  • Accidents occurring on our premises, unless directly caused by willful misconduct by Siesta Coffee staff.

Customers assume full responsibility for their own actions and any consequences arising from their interactions with Siesta Coffee.

3. Food Allergies and Dietary Restrictions

Customers are responsible for informing Siesta Coffee of any food allergies or dietary restrictions before placing an order. While we take reasonable measures to prevent cross-contamination, we cannot guarantee an allergen-free environment.

Disclaimer:
Siesta Coffee shall not be held liable for any allergic reactions or health complications related to food consumption, even if the customer has disclosed an allergy. Customers agree to consume food and beverages at their own risk.

4. Assumption of Risk

By entering Siesta Coffee premises or consuming our products, you acknowledge that you do so at your own risk. This includes any potential risks associated with food preparation, consumption, and general use of our facilities (including Wi-Fi, seating areas, and restrooms).

Siesta Coffee is not responsible for any property damage, personal injury, or losses occurring on our premises unless caused by deliberate actions of our staff.

5. Limitation of Liability

To the fullest extent permitted by law, Siesta Coffee, its employees, affiliates, and agents will not be liable for any direct, indirect, special, incidental, or consequential damages arising from:

  • The use or inability to use our services or products.
  • Food or drink consumption.
  • Use of facilities, including accidents, theft, or loss of personal property.

In any event, Siesta Coffee's total liability to a customer shall not exceed the amount paid for the specific service or product in question.

6. Health and Safety

Customers are required to comply with all posted health and safety notices in Siesta Coffee locations. Customers are responsible for supervising children or vulnerable individuals under their care while on the premises. Siesta Coffee reserves the right to refuse service or ask customers to leave the premises if they fail to comply with safety regulations or act in a manner that endangers others.

7. Waiver of Claims

By using Siesta Coffee facilities or purchasing our products, customers expressly waive their right to bring any claims against Siesta Coffee, including but not limited to claims related to:

  • Negligence
  • Accidents and injuries
  • Food-related illnesses (including but not limited to allergies, intolerances, and foodborne illnesses)
  • Loss of or damage to personal property

8. Refunds and Cancellations

Siesta Coffee offers replacements only in cases where products are proven to be defective or significantly different from what was advertised:

  • We only replace products that have not been consumed and are faulty (e.g., perished).
  • We offer replacements only, not refunds.
  • Replacements must be verified by proof of receipt/purchase.
  • Replacement requests must be made at the store where the original purchase was made.
  • Replacements from other stores are strictly prohibited.
  • All replacements are at the discretion of Siesta Coffee.

9. Use of Facilities

Siesta Coffee provides Wi-Fi and seating areas as a courtesy to customers. However, we reserve the right to restrict the use of these services at any time. Customers must not:

  • Use Wi-Fi for illegal activities or offensive content.
  • Occupy seating areas for extended periods without making a purchase.

Siesta Coffee is not liable for any data breaches, hacking, or security issues while using its free Wi-Fi services.

10. Conduct and Behavior

Customers are expected to behave respectfully and courteously while on Siesta Coffee premises. Siesta Coffee reserves the right to refuse service or remove individuals from the premises if they:

  • Cause disruption or disturbances.
  • Engage in threatening, offensive, or abusive behavior.
  • Fail to comply with staff instructions.

We reserve the right to report unlawful behavior to law enforcement authorities.

11. Indemnity

Customers agree to indemnify, defend, and hold harmless Siesta Coffee, its affiliates, directors, employees, and agents from any third-party claims, demands, liabilities, damages, or expenses arising from:

  • Breach of these Terms and Conditions.
  • Violations of any law or third-party rights.
  • Customer negligence or misconduct on our premises.

12. Force Majeure

Siesta Coffee will not be held liable for any delay or failure to perform its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to acts of God, pandemics, government restrictions, natural disasters, strikes, or supply chain disruptions.

13. Privacy and Data Protection

Siesta Coffee respects your privacy and will only collect, store, and use your personal data in accordance with applicable privacy laws, including the General Data Protection Regulation (GDPR). We do not share your data with third parties without your consent, except as required by law or in connection with the operation of our business.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or related to these Terms and Conditions shall be resolved exclusively through mediation or arbitration, failing which they may be brought in the courts of the United Kingdom.

By using our services, you agree to waive your right to a jury trial or class-action lawsuit.

15. Amendments to Terms

Siesta Coffee reserves the right to amend or update these Terms and Conditions at any time without prior notice. Customers are encouraged to review the Terms regularly. Continued use of our facilities and services constitutes acceptance of the updated Terms.

16. Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
